Since, the proceedings are under the SARFAESI Act, 2002, we are not inclined to entertain the writ petition, particularly as forum for adjudication of such issues would be before the Debt Recovery Tribunal under Section 17 of the SARFAESI Act, 2002. The view we take is otherwise in accord with the judgment of Supreme Court in United Bank of India Vs. Satyawati Tondon & Ors., 2010 (8) SCC 110. Accordingly, the petition is consigned to records.
