Petitioner's claim for payment of compensation under the Chief Minister Farmer Accident Welfare Scheme, has been rejected by the District Magistrate after recording a finding that death of the deceased occurred on account of an offence for which first information report has also been registered under Section 302 I.P.C. Reliance has been placed upon Government Order, according to which, where death has occurred on account of an offence, the benefit of awarding compensation for accidental death will not be available. In view of the specific policy for not extending the benefit of compensation where the death is a result of an offence and first information report has been lodged, we do not find any error in the order of the District Magistrate rejecting the claim of the petition.
