Judgment text excerpt
Neutral Citation No. - 2025:AHC:31389-DB Court No. - 29 Case :- WRIT - C No. - 6428 of 2025 Petitioner :- Smt. Hausila Devi Respondent :- State Of U.P. And 10 Others Counsel for Petitioner :- R S Dubey,Savita Dubey Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Petitioner claims to have obtained a fishery license from sixth respondent, who is a private society. It is alleged that respondent nos. 7 to 11 are interfering with such rights. Prayer is to command the authorities to injunct the private respondents. Learned State Counsel raised the objection to the maintainability of the writ petition on the ground that there exists private civil dispute between the petitioner and private respondents, for which writ would not be the appropriate remedy. Since, the fishery lease is in favour of the petitioner from the sixth respondent, who is a private society, the dispute between the petitioner and the private respondents cannot be a subject matter of consideration in a writ. For such private dispute, remedy would be before the competent Civil Court. The writ petition is dismissed, accordingly. Order Date :- 5.3.2025 Noman Digitally signed by :- NO
