Petitioner wants this Court to issue a direction to the State authorities to not obstruct repair of the alleged damaged boundary and gate situated on his bhumidhari land over Gata No. 1033, Khalsa Uttar Dakshin Tola, Tehsil Sadar, District Mau. The petition is opposed by learned Standing Counsel, who states that there is a private dispute in respect of such land and the persons with whom the dispute is pending, have not been arrayed as party respondents. Learned counsel for the petitioner states that the dispute is in respect of Plot No. 1034, whereas the petitioner is raising construction on Plot No. 1033. Apparently, Plot Nos. 1033 and 1034 are adjoining plots. Once, there is a dispute with regard to the possession of the parties over the land, in respect of which the proceedings are pending before the Civil Court, we are not inclined to issue any direction on the petition
