Award dated 31.10.2023 passed by the facilitation council under the MSMED Act, 2006 is challenged in this case. An objection is taken to the maintainability of the writ petition on the ground that reference to facilitation centre is on a reference under sub-section 1 of Section 18 of the MSMED Act, 2006 and since the provisions of Arbitration and Conciliation Act, 1996 would be attracted the remedy of the petitioner would be under the Act of 1996. Once the award has been made the remedy of the petitioner would be under the Act of 1996. A writ would not lie for such purposes. Writ petition is, consequently, dismissed.
