Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Heard learned counsel for the petitioner and Shri Vivek Kumar Singh, learned counsel for the respondent. An office memorandum dated 27.08.2024 is challenged. A further prayer is made to restrain the respondents from deducting amount of Rs.9,22,829.33/-. An objection is taken to the maintainability of the writ on the ground that the action of respondents is pursuant to contract which contains arbitration clause. In such circumstances, it is argued, that remedy of the petitioner would be before the Arbitrator. Learned counsel for the petitioner states that application under Section 9 has been filed. The grievance is that such application has not been considered. If that be so, remedy of the petitioner would be to pursue the proceedings under Article 227 of the Constitution of India.
