Heard learned counsel for the petitioner and Shri P.N. Tripathi, learned counsel for the respondent- Bank. Petitioner wants a direction to be issued to the respondent-Bank to release the amount lying in account No.21952295325 held by her deceased son. Learned counsel for the Bank points out that the deceased son had appointed his wife Smt. Kiran as being the nominee and therefore, the amount cannot be paid to the petitioner. Once the petitioner is not the nominee and the nominee otherwise is not a party impleaded before us, we are of the view that private dispute between the petitioner and the nominee can only be adjudicated by the competent civil court. No direction can be issued to the Bank not to release the amount to the nominee. Accordingly, the present writ petition is dismissed.
