Heard learned counsel for the petitioner and Sri Uttam Singh for the respondent Bank. This petition is directed against a notice issued by the Bank under Rule 8(1) of the Security Interest (Enforcement) Rules, 2002. Since the decision has not been taken, the Bank has now issued a fresh notice under Section 13(2) of the Securitisation and Reconstruction of Finance Assets and Enforcement of Security Interest Act, 2002 against the petitioner. 60 days time has been granted to the petitioner to clear all the liabilities. Copy of this notice has been served upon counsel for the petitioner. In view of the subsequent developments, noticed above, this writ petition is rendered infructuous, inasmuch as, the Bank shall be at liberty to proceed only under the subsequent notice issued under Section 13(2) of the Act of 2002, dated 1.2.2025.
