And 4 Others Counsel for Petitioner :- Bhaju Ram Pprasad Sharma Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Pursuant to the orders passed on previous occasion, learned State Counsel has obtained instructions from the Divisional Forest Officer, according to which, the trees were cut without obtaining permission from the forest authorities and therefore, the logs have been seized. Criminal proceedings have also been initiated against the husband of the petitioner in respect of unauthorized cutting of trees as well as seizure of logs. Once proceedings under the appropriate enactment have been initiated against the husband of the petitioner, the remedy of the petitioner would be to approach the competent Court in terms of the applicable statute for release of such seized goods. Writ petition would not lie for such purpose.
