Petitioner is aggrieved by the action of fourth respondent which is a private finance company. Certain loan apparently was availed for purchase of Mahindra Bolero vehicle. Dispute is raised with regard to action of respondent in repossessing the vehicle. Since the loan has been provided to the petitioner by the private finance company, we find substance in the objection taken by the respondents to the maintainability of the writ, inasmuch as such a petition would clearly not be maintainable as the respondent finance company does not answer the description of State within the meaning of Article 12 of the Constitution of India.
