Grievance of the petitioner is against the third-respondent which is a private Company. An objection is taken to maintainability of the writ on the ground that third-respondent is not State within the meaning of the Constitution of India. It is apparent that criminal proceedings have already been initiated by the petitioner against the third-respondent. No writ would lie against the third-respondent. No provision is otherwise shown under which District Magistrate can be directed to secure the return of the amount. Leaving it open for the petitioner to pursue appropriate remedy before the competent forum, this petition is consigned to records.
