Heard learned counsel for the parties. It is alleged that certain persons have made encroachment over the land in question. None of those who allegedly have encroached the land is impleaded as a respondent. Even otherwise, if encroachment is on the State land, remedy would be before the competent authority under Section 67 of the U.P. Revenue Code, 2006. Otherwise, if the encroachment is on private land, remedy would be before the competent civil court. In that view of the matter, filing of the writ petition is utterly misconceived and is accordingly dismissed.
