Delay Condonation Application No. 1 of 2024 and Restoration Application No. 2 of 2024. 1. Heard Sri Neeraj Kumar Tripathi, learned counsel for the petitioner/applicant. 2. The instant applications have been filed to recall the order dated 04.02.1997 dismissing the writ petition for want of prosecution along with the prayer for condonation of delay of 27 year. 3. Learned counsel for the petitioner/applicant submitted that sole petitioner (father of deponent) has died on 04.11.2011 and deponent was not aware about the order dated 04.02.1997, as such delay in filing the restoration application be condoned and restoration application should be allowed so that matter may be decided/adjudicated on merit. 4. Learned Standing Counsel submitted that restoration application is highly time barred and property in dispute is situated under State of Uttarakhand, as such applications are liable to be rejected.
