Brief facts of the case are that against the order dated 25.07.2016 passed by Consolidation Officer in the proceeding under Section 9A(2) of the U.P.C.H. Act an appeal under Section 11(1) of the U.P.C.H. Act was filed by petitioner, which was registered as appeal no. 428 of 2016. In appeal no. 428 of 2016, Kunta Devi filed an impleadment application, which was allowed by Settlement Officer Consolidation. The aforementioned appeal was heard and decided vide order dated 23.02.2018 setting aside the order dated 25.07.2016 passed by Consolidation Officer and remitted the matter back for afresh adjudication of dispute by Consolidation Officer under Section 9A(2) of the U.P.C.H.
