Hon'ble Ajit Kumar,J. Heard learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner is seeking compassionate appointment on account of his father dying in harness. It is submitted that the petitioner has been directed to furnish certain details, whereas, the fact is that the petitioner's mother is in government service though on Class - IV post. Learned Standing Counsel submits that in view of the provisions as contained under Rule 5 of the Dying in Harness Rules, 1974 the employment on compassionate basis to the heirs cannot be given, if one of the spouse is in service. Learned counsel for the petitioner could not dispute the above. In view of the above, no direction can be issued for compassionate appointment of the petitioner.
