Sri Agam Narain Roy, learned counsel for the respondent has raised preliminary objection as to the maintainability on the ground that the Forest Department stands notified under Section 14 of Central Administrative Tribunals Act, 1985 and hence matter is cognizable by Central Administrative Tribunal. Learned counsel for the petitioner could not dispute the above. In view of the above, I decline to grant indulgence in the matter at this stage. However, petitioner shall be at liberty to apply before the Central Administrative Tribunal, if so advised. Subject to aforesaid liberty, this petition consigned to records.
