Learned counsel for the petitioner submits that the controversy is no more res integra in view of judgment of this Court in the case of Ghanshyam Tiwari v. State of U.P. and Others (Writ A No. 44330 of 2013) decided on 7.9.2012, which has come to affirmed in special appeal, against which Special Leave Petition has also been dismissed.
