Submission advanced by learned counsel for the petitioner is that earlier landlord has instituted the suit before the Judge Small Causes under the Provincial Small Causes Courts Act, 1887, however, later on he withdrew the suit by moving application and application came to be allowed without any further liberty on 13th August, 2014 and yet again he instituted a rent case for eviction before the rent authority under the Act no. 16 of 2021 on 26th July, 2024. It is further submitted that in view of the fact that there is no rent agreement between the parties and tenancy is covered under the new Act No. 16 of 2021, the proceeding of the rent case is governed under Provincial Cause Courts Act in the light of judgment of this Court in the case of Amit Gupta v. Gulab Chandra Kanodia,
