Heard Sri Nitin Sharma, learned Advocate holding brief of Sri V.C.Tiwari, learned counsel for the petitioner and learned Standing Counsel . By means of present petition filed under Article 226 of the Constitution, petitioner has questioned the order dated 13th August, 2025 passed by rent authority. Learned Standing Counsel submits that the petitioner has an alternative efficacious remedy of statutory appeal under Section 35 of Act No. 16 of 2021. Learned counsel for the petitioner does not dispute the above legal position. In view of above, I decline to grant indulgence in the matter, however liberty rests with the petitioner to prefer appeal under Section 35 of Act no. 16 of 2021 in accordance with the procedure prescribed and the format prescribed therefor within a period of two weeks from today before the appellate authority and in the event petitioner prefers appeal, the same shall be considered and decided by the appellate
