The petitioner before this Court is an applicant for the post of Constable (GD) in CAPF/ NIA/ SSF and Rifleman (GD) in Assam Rifles Examination - 2024. Petitioner qualified physical eligibility test but ultimately was declared medically unfit for hypertension and hence in both medical and review medical petitioner got declared unfit for these above reasons. The petitioner now has approached this Court for granting one more opportunity to undergo medical examination afresh as according to him in one similar examination earlier held in 2021 petitioner was found medically fit and subsequently in November, 2024 when he got checked up at District Hospital, Aurangabad, Bihar, he was declared fit. Since the controversy involved in this petition for the purpose of medical test for third time is no more res integra in the light of the judgment of this Court in the case of Miss Neha v. State of U.P. and others passed in
