K. Singh Kaosik Hon'ble Ajit Kumar,J. Petitioner wants re-medical having been declared medically unfit in the first round of medical test. Learned counsel for the respondent has raised objection to the maintainability of the petition on the ground that petitioner has an alternative efficacious remedy of appeal, if he was declared unfit. Countering submission learned counsel for the petitioner submits that appeal was preferred and attention has been drawn as annexure 8 to the petition and on perusal of annexure 8, I find it to be addressed to the Staff Selection Commission. In the considered view of the Court, Staff Selection Commission is not competent authority in the matter to conduct the medical fitness test as it is done only after selection offered by the competent authority of the department concerned by constituting medical board.
