In compliance of earlier order of this Court Sub Divisional Magistrate, Sri Anupam Mishra as well as Alok Kumar, then Sub Divisional Magistrate have appeared before this Court and and produced the original record. From the perusal of the original records, it transpires that the enquiry officer/ Nayab Tehsildar did not find the charges proved against the petitioner in his report, specially charge no. 2, however, disciplinary authority while issued a show cause notice did not show any disagreement with report just called for explanation from the delinquent employee, namely, petitioner and show cause notice was issued to him on 7.2.2025 and reply thereof was submitted by the petitioner. It appears that disciplinary authority himself proceeded to hold fresh enquriy into charges to hold petitioner guilty though partially in respect of charge no. 2, and hence, directed penalty though minor in nature, to be imposed against the pet
