Heard learned counsel for the parties and perused the records. 2. The petitioner is aggrieved by the order of major penalty dated 13.09.2023. 3. Learned Standing Counsel has raised a preliminary objection as to the maintainability of the writ petition on the ground that the petitioner has efficacious alternative remedy of appeal under Rule 11 of the Uttar Pradesh Government Servants (Discipline and Appeal) Rules 1999. 4. Learned counsel for the petitioner could not dispute the above legal proposition. 5. In view of the above, I hereby decline to grant indulgence in the matter, at this stage. 6. However, it is provided that in the event the petitioner prefers a statutory appeal before the designated Appellate Authority within a period of six weeks from today, the same shall be entertained and decided on merits as expeditiously as possible, preferably within a period of two months in accordance with la
