By means of the present petition filed under Article 226 of the Constitution of India, the petitioner has challenged the order dated 07.09.2024, whereby, he had been directed to deposit the amount of excess payment to the tune of Rs.12 Lakhs amount so that his post retirement dues could be cleared. 2. In view of the judgment of the Supreme Court in the case of [State of Punjab and others v. Rafiq Masih (White Washer); 2014 Law Suit (SC) 1075], recovery could not have been done. An affidavit of compliance has been filed by learned Standing Counsel duly sworn by the Superintendent of Police, Budaun, Dr. Brijesh Kumar Singh. In paragraph no.3 of the compliance affidavit, it is averred that Rs.11 Lakhs amount has been paid. This transaction of the money in the bank account of the petitioner with IFSC Code is not part of the record of the affidavit. 3.
