An application under Section 5 of the Limitation Act has been filed seeking condonation of delay. 3. For the reasons indicated in the application supported by an affidavit, the same is allowed. 4. The delay in filing the appeal is condoned. 5. The learned counsel for the appellant submits that the learned Single Judge while passing the impugned order dated 05.10.2006 followed the judgment in Prabhu Narain Sharma and others Vs. State of U.P. and others : Writ Petition No. 5505 (S/S) of 1999, decided on 26.08.1999. 6. The said judgment in the case of Prabhu Narain Sharma (supra) has been reversed by the Division Bench in State of U.P. and others Vs. Prabhu Nara
