The present writ petition has been filed in public interest seeking a writ of mandamus directing the respondent nos. 2 and 3 to restrain the respondent no. 4 i.e. Gram Panchayat from making construction of the fair price shop. 3. The writ petition instituted by the petitioner in public interest is misconceived for the reason that by virtue of Article 243G of the Constitution of India, the State legislatures can give Panchayats the powers and authority they need to function as self-governing institutions.
