Heard learned Counsel for the petitioner as well as learned Standing Counsel. 2. The present petition has been filed with the following prayer: "(i) Issue a writ, order or direction in the nature of mandamus commanding the opposite parties specially the opposite parties specially the opposite party no. 2 & 3 to remove the illegal encroachment over the Land Gata No. 207 recorded as pond situated at Village Lauhar Paschim (Pure Jorai), Banakepur, Tehsil-Sadar, District-Sultanpur, which is contained as Annexure No. 1 to this writ petition, in the interest of justice." 3. Learned Standing Counsel on the basis of the counter affidavit states that the action is proposed to be taken for cancellation of allotment in favour of the person concerned which is under way. 4. Considering the said statement, the present petition is disposed off expecting that the acti
