THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.2762 of 2025 ORDER: 1. Heard the learned counsel for the petitioner. 2. The petitioner was arraigned as A.5 in Crime No.177 of 2024 of Rangampeta Police Station, East Godavari District, registered for the alleged offences under Sections 353(2), 352, 196 of the Bharatiya Nyaya Sanhita 2023. 3. The learned counsel for the petitioner submits that there are no specific allegations against the petitioner, and he was falsely implicated in the complaint. It is alleged in the complaint that the petitioner posted defamatory content on the social media platform, i.e., Facebook, against the political leaders. The learned counsel further submits that the offences alleged against the petitioner are punishable below 7 years and therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4.
