THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.2673 OF 2025 ORDER: 1. Heard the learned counsel for the petitioner. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as Accused in Crime No.27 of 2025 of Maanapalle I Town Police Station, Madanapalle, Annamayya District, registered for the alleged offence under Section 85 of the Bharatiya Nyaya Sanhita 2023. 3. The learned counsel further submits that the 2nd respondent is the wife of the petitioner. On account of certain marital disputes between them, the 2nd respondent has filed a complaint against the petitioner. The learned counsel further submits that the offence alleged against the petitioner is punishable below 7 years and therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Madanapalle I Town Police Station, Madanapalle, Annamayya District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya 2 Nagarik Suraksha Sanhita, 2023, for the purpose of investigation
