Neutral Citation No. - 2025:AHC:38010 Court No. - 65 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 8083 of 2025 Applicant :- Gautam Opposite Party :- State Of U.P. And 3 Others Counsel for Applicant :- Rakesh Dubey Counsel for Opposite Party :- G.A. Hon'ble Krishan Pahal,J. 1. List has been revised. Learned A.G.A. has informed that notice to the informant has been served on 1.3.2025. 2. Heard learned counsel for the applicant as well as Sri R.P. Singh, learned State Law Officer and perused the material placed on record. 3. Applicant seeks bail in Case Crime No. 442 of 2024, under Sections 64, 137(2) B.N.S. and 3/4 POCSO Act, 2012, Police Station Rasulabad, District Kanpur Dehat, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The FIR is delayed by three days and there is no explanation of the said delay caused. The victim seems to be the consenting party, as is evident from the fact that she had gone with the applicant all the way to Maharashtra and travelled to several places through different modes of transportation and had not raised any alarm, whatsoever.
