Heard Sri Arvind Prabodh Dubey, learned counsel for the applicant, Sri Ram Mohit Yadav, learned A.G.A. for the State as well as perused the material placed on record. 3. Applicant seeks bail in Case Crime No. 298 of 2024, under Sections 87, 70, 351(3), 352(2) of BNS Police Station Kubersthan, District Kushi Nagar, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. He has nothing to do with the said offence. The FIR is delayed by about 1 day and there is no explanation of the said delay caused. There is no medical corroboration of the said incident as the victim had refused her internal examination. The victim herself has categorically deposed before the police that she has married the applicant but subsequently in her statement recorded under section 18
