This is the second bail application on behalf of the applicant. The first bail application was dismissed as not pressed with liberty to file fresh vide order dated 22.02.2024. The Court proceeds to consider the 2nd bail application on merits. This 2nd bail application under Section 439 Cr.P.C. has been moved on behalf of accused-applicant, Dhaniram, seeking enlargement on bail in Case Crime No. 362 of 2023, under Sections 307 of the Indian Penal Code and Section 3/25 of Arms Act, Police Station- Kamalganj, District- Farrukhabad. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 03.09.2023.
