Applicant seeks bail in Case Crime No. 35 of 2024, under Sections 376 I.P.C., Police Station Mahila Thana, District Gorakhpur, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. He has nothing to do with the said offence. The FIR is delayed by about 4 months and there is no explanation of the said delay caused. There is no medical corroboration of the said incident. It is true that the victim was found pregnant and the said fetus was aborted at the behest of the victim herself. It is a case of consensual relationship.
