Applicant seeks bail in Case Crime No. 472 of 2023, under Sections 376D, 506, 341 of I.P.C., Police Station - GIDA, District - Gorakhpur, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. He has nothing to do with the said offence as alleged in the FIR. The applicant is not named in the FIR. His name does not find mentioned in the statement of the victim recorded u/s 161 & 164 Cr.P.C.. Although, the name of the applicant has subsequently come up in the statement of the boyfriend of the victim and that too is having allayed suspicion only. 5.
