Applicant seeks bail in Case Crime No. 099 of 2023, under Sections 363, 376 I.P.C. and 3/4 POCSO Act, Police Station Kotwali, District Shahjahanpur, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The victim seems to be the consenting party, as is evident from the circumstances, as narrated by the victim in her statement recorded u/s 164 Cr.P.C., whereby she had gone with the applicant to Bareilly turn and thereupon to Moradabad and then to Punjab and had not raised any alarm, whatsoever.
