Heard Sri Ramesh Kumar Pandey, learned counsel for the applicant and Sri Vidya Dhar Yadav, learned counsel for the informant as well as Sri R.P. Patel, learned A.G.A. for the State Law Officer and also perused the material placed on record. 3. Applicant seeks bail in Case Crime No.82 of 2024, under Sections 363, 376 I.P.C. and Section 3/4 (2) POCSO Act, 2012, Police Station Kailadevi, District Sambhal, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. He has nothing to do with the said offence as alleged in the FIR. The FIR is delayed by about three days and there is no explanation of the said delay caused. 5. Learned counsel has also stated that the victim is the consenting party as is evident from her statement recorded u/s 164 Cr.P.C. The
