Applicant seeks bail in Case Crime No.314 of 2024, under Sections 376(3), 504, 506 I.P.C. and 3/4(2) POCSO Act, Police Station- Kairana, District- Shamli, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The victim is a consenting party as is but evident from the circumstances as narrated by her in the statement recorded U/s 164 Cr.P.C., whereby she has stated that she was disrobed by the applicant, as such, there is no sign of struggle whatsoever.
