This is second bail application of the applicants. First bail application of the applicants was rejected by the coordinate Bench of this court on 30.08.2024 which is not available now. Counsel for the applicants submits that as yet trial has not commenced. No prosecution witness has been examined till date. The applicants have been falsely implicated in this case. They are in jail since 10.07.2023 and have no criminal history to their credits. On the other hand learned A.G.A has opposed the prayer for bail. Keeping in view the nature of the offence, evidence, complicity of the accused, submissions of the learned counsel for the parties, larger mandate of the Article 21 of the Constitution of India, considering the dictum of Apex Court in the case of Dataram Singh Vs. State of U.P. and another reported in (2018) 3 SCC 22 and recent judg
