Heard learned counsel for the applicant, learned AGA for the State and perused the material placed on record. The instant bail application has been filed on behalf of the applicant, Devesh Dhakre with a prayer to release him on bail in Case Crime No. 131 of 2024, under Sections 419, 420, 467, 468, 471, 34 of IPC and Section 66D of the Information Technology (Amendment) Act, Police Station Cyber Crime, District- Agra, during pendency of trial. There is allegation against the applicant of incriminating recovery of one mobile phone was made from him by the police. Learned counsel for the applicant submits that the mobile phone belongs to the applicant himself. He has been falsely implicated in this case. The applicant has criminal history of two cases. He is in jail since 27.09.2024 and he undertakes that he will not misuse liberty, if granted. Learned A.G.A. has vehemently opposed the submissions made by learned cou
