By means of this application, the applicant, Sushil Saxena, who is involved in Case Crime No. 473 of 2024, under Sections 60/72 of Excise Act and 274, 275, 318, 319, 336, 338, 340 of the Bharatiya Nyaya Sanhita, 2023, Police Station Subhash Nagar, District- Bareilly and is in jail since 08.10.2024, is seeking enlargement on bail during the trial. It is submitted by learned counsel for the applicant that similarly placed co-accused, Krishna Pal @ Kp, has already been enlarged on bail by this Court by order dated 6.2.2025 passed in Criminal Misc. Bail Application No. 41246 of 2024. He has further submitted that since the role of the applicant is identical to that of co-accused, Krishna Pal @ Kp, who has already been enlarged on bail, he is also entitled to be enlarged on bail on the ground
