This bail application under Section 439 Cr.P.C. has been moved on behalf of accused-applicant, Shoaib Akhtar, seeking enlargement on bail in Case Crime No. 237 of 2024, under Sections 8/20 of Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station- Pakbada, District- Moradabad. 3. Learned counsel for the applicant has contended that 1200 gram of Charas is alleged to have been recovered from the possession of the applicant, which is above commercial quantity. In fact no such recovery was effected from the applicant.
