The present appeal has been filed against the judgment and order dated 1.2.2002 passed by the learned Additional Sessions Judge, Court No. 10, Kanpur Nagar, in Sessions Trial No. 1433 of 1990, under Sections 498-A, 304-B IPC and Section 3/4 Dowry Prohibition Act, Police Station Chakeri, District Kanpur Nagar. 2. When the case is called out no one has appeared to press the appeal on behalf of the appellant. However, on perusal of the office report dated 6.2.2024 based on the report dated 25.7.2023 submitted by the Chief Judicial Magistrate, Etawah dated 20.6.2023, it transpires that sole appellant-Phoola @ Phoolan Devi has died about 6 years back. The statements of her son Rajesh Kumar and her husband Ganga Sahai have also been recorded apart from the statements of Gram Pradhan and the Sub-Inspector concerned. 3. In such view of the matter, the appeal stands abated. 4.
