Present appeal has been filed challenging the order dated 17.12.2003 passed by learned Additional District & Sessions Judge, Court No. 7, Muzaffarnagar in Sessions Trial No. 1062 of 2002 (State vs. Rakesh and others), under Sections 302, 323, 506 I.P.C. 3. Perused the office report dated 22.12.2021 and report submitted by the Chief Judicial Magistrate, Muzaffarnagar dated 25.11.2021, according to which the sole appellant-Rakesh died on 14.9.2012. Along with report of the CJM , Muzaffarnagar statements of Mohit s/o Rakesh (appellant herein), Smt. Kamlesh (wife of appellant herein) and Sri Girish Chand, Sub Inspector posted at Police Station Purkaji and death certificate issued by Govt. of U.P. have been annexed. 4.
