The grievance raised in the present writ petition for the relief sought is already sub judice before the Civil Judge (Junior Division) Kadipur, Sultanpur in Regular Suit No.390 of 2023. Simultaneous proceedings relating to the same subject matter/cause are not maintainable. Thus, the present writ petition is declined to be entertained with a liberty open to the petitioner to pursue the pending proceedings before the competent civil court. In case the interim injunction application is filed under Order 39 Rule 2 A C.P.C, the competent civil court is hereby directed to proceed with the same and pass necessary orders expeditiously in accordance with law.
