It is a case of circumstantial evidence. The named accused Phoolchandra has named the applicant in his statement and she has been falsely implicated in this case. Recovery of one mobile phone and Rs.150/- have been made from her. Learned counsel for the applicant submits that the recovery made from the applicant does not implicate her in this case. Even otherwise, the applicant has been implicated on the basis of confessional statement of co-accused Phoolchandra, which cannot be read against her at this stage. She is a woman.
