Heard learned counsel for the applicant as well as learned A.G.A. for the State and perused the record. 2. By means of this bail application, applicant seeks bail in Case Crime No. 181 of 2022, under Sections- 302, 394, 411, 120B, 34 I.P.C., Police Station- Lanka, District- Varanasi, during pendency of trial. 3. Learned counsel for the applicant submits that though in his statement recorded under Section 161 Cr.P.C. the informant has alleged that recovery memo was prepared in his presence, but after the bail rejection order, the informant appeared at trial as P.W.1 and in his cross-examination he has specifically stated that no recovery memo was prepared in his presence. Thus, learned counsel argued that in absence of any witness of the alleged incident the whole case rests upon the circumstantial evidence and the applicant was made accused on the basis of alleged recovery
