Learned A.G.A. for the State submits that instructions have been received and has no objection in case the bail application is heard on merits. 2. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 3. It is submitted by learned counsel for the applicant that applicant is not named in the FIR. Allegations in the FIR is that the brother of the informant has been assaulted by some unknown persons, as a result of the same, he has died. Learned counsel for the applicant submits that name of the applicant has come up in the statement of Smt. Shanti, who has stated that she has been informed that applicant has got the deceased assaulted through Avinash and Ashu.
