By means of the the bail application the applicant has prayed to be enlarged on bail in Case Crime No. 59 of 2025 at Police Station- Deoband, District- Saharanpur under Sections 3(5), 191(1), 190, 109(1), 103(1), 115(2) B.N.S. The applicant is in jail since 01.02.2025. The bail application of the applicant was rejected by the learned trial court on 09.05.2025. The following arguments made by Sri A.Z.Khan, learned counsel on behalf of the applicant, which could not be satisfactorily refuted by Sri Suchit Tandon, learned AGA-I from the record, entitle the applicant for grant of bail: 1. A vague and a general role has been assigned to the applicant in the FIR. 2. The applicant has been nominated at the instigation of an inimical parties in the village. The applicant had no motive to commit the offence. 3. The FIR identifies one Usmaan and Naeem as the principal offenders who discharged their firearms and shot dead the deceased. 4
