By means of the bail application the applicant has prayed to be enlarged on bail in Case Crime No. 25 of 2025 at Police Station- Pisava, District-Aligarh under Sections103 (1), 109(1), 61(2) of BNS. The applicant is in jail since 25.02.2025. The bail application of the applicant was rejected by the learned trial court on 24.03.2025. The following arguments made by Shri Rafeek Ahmad Khan, learned counsel on behalf of the applicant, which could not be satisfactorily refuted by Sri Shashi Dhar Pandey, learned AGA from the record, entitle the applicant for grant of bail: 1.The applicant was falsely implicated in the F.I.R. at the instigation of inimical parties in the village. 2. No direct role has been attributed to the applicant in the shoot out. 3. The applicant has not been identified as the principal offender who discharged his firearm. 4. According to the eye witness the three principal offenders namely
