Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material on record. 2. The present bail application has been filed on behalf of the applicant in case crime No. 73 of 2025, under Sections 318(4), 336(3), 338, 340(2) BNS and Section 60, 63, 72 of Excise Act, police station Lanka, District Varanasi, with the prayer to enlarge the applicant on bail. 3. It has been argued by learned counsel for applicant-accused that the applicant is innocent and he has been falsely implicated in this case. Alleged recovery of 320 cartons of illicit liquor was shown from the truck. Applicant is not driver of the said truck and he has no concern at all with the alleged recovery. Applicant was merely travelling as a passenger in the said truck. The driver of the said truck has ran away and applicant was falsely implicated.
